No one in the State of Texas who receives a driver's license is required to perform any coordination exercises to prove whether or not they are able to walk a straight line or stand on one leg without falling down. However, the "walk-and-turn" test and the "one-leg stand" test are two tests of a battery of three exams that make up the standardized field sobriety tests, which the majority of police officers have been trained to administer on suspected intoxicated drivers. The standardized field sobriety tests were first developed by the National Highway Transportation Safety Administration under "scientific conditions". Their research determined that a person's ability to stand on one leg or walk straight down an imaginary line somehow corresponded to a specific level of intoxication. Police officers are professional witnesses for the prosecution. They have been trained by their various agencies and local prosecutors on using magic words during a DWI trial in an attempt to correlate a person's coordination with intoxication and inability to operate a vehicle. The Myers Law Firm will aggressively peel back the layers of the police officer's testimony and reveal it to the jury for what it is - junk science. |
